В целом по стране популярны удостоверения ФСБ и Прокуратуры, на их долю выпадает 80% всех подделок. Удостоверения Следственного комитета и судей пользуются значительно меньшим успехом.

Россияне в целом не очень хорошо разбираются в хитросплетениях административного аппарата, поэтому чаще всего верят тому, кто держит в руках удостоверение Министерства внешних дел, Федерального комитета по защите конституционного строя, Федерального агентства правопорядка, Комиссии президента по борьбе с должностными злоупотреблениями и так далее. Сотруднику ГИБДД тоже проще пропустить человека с удостоверением и не тратить на него свое время.

Аббревиатура «отдел по борьбе с преступностью и коррупцией России», стопудово некоторые граждане поведутся, - пишет участник форума по изготовлению «фантиков» под ником «Андрюха».
И в целом он прав: распространенное незнание существующих служб раздутого государственного аппарата в России порождает такие казусы.

«Фантики» - самый многочисленный класс поддельных удостоверений. Цены на товары ремесленников от ксивостроения формируются в зависимости от наглости и самоуверенности производителей. Третий тип удостоверений - документы общественных организаций, призванных создать иллюзию близости к силовым ведомствам. В качестве психологического оружия они применяются достаточно успешно. Шутка ли, если человек показывает вам удостоверение «Союза ветеранов ФСБ» и заявляет, что после звонка бывшие коллеги могут запросто завести на вас дело по статье «подготовка к теракту»? Цена на удостоверение организации такого рода начинается от 15 тыс. рублей. Называться контора к «корочке» может по-разному: «Союз содействия АНТИТЕРРОР», «Общество бывших сотрудников МВД», «Союз ветеранов холодной войны», «Фонд поддержки офицеров ФСБ», «Общество добровольного содействия работникам прокуратуры», «Союз предпринимателей ветеранов органов внутренних дел» и т.п.

Бывают и вовсе абсурдные случаи. Однажды, например, подмосковная полиция (тогда еще милиция) задержала некого гражданина по фамилии Якута в связи с хищением 14 млн рублей. На допросе Якута предъявил следователю удостоверение с надписью: «Главное разведывательное управление. Генеральный штаб ВС РФ». Ниже - личный номер. На следующей странице внушающая уважение надпись: «Подразделение «Р.О.С.А.». Войска специального назначения ГРУ ГШ ВС РФ», и далее – «Просьба всем государственным служащим оказывать содействие предъявителю удостоверения при исполнении служебных обязанностей». Но увенчалось все это печатью, на которой крупными буквами была выведена аббревиатура ГРУ ГШ, а ниже маленькая подпись «Общественная организация».

Через поисковик можно найти сотни форумов, где не только предлагают купить «фантики», но и обсуждают, какие из них больше всего похожи на удостоверения реальных организаций и служб. Там же происходит обмен опытом и мастер-классы по имитации средств защиты. Чаще всего речь идет о голографической пленке с ничего не значащими переливающимися буквами «РФ» или государственным гербом, которые есть в свободной продаже.
Сотрудники ФСБ борются с подделками: организуют рейды, инструктируют сотрудников ГИБДД по поводу средств защиты, отлавливают производителей и распространителей поддельных документов. Эти меры дают результат: доверие к «корочкам» падает.
Если раньше такой человек мог пятнадцать раз использовать свое поддельное удостоверение, то теперь, говоря условно, раза два, - комментирует опыт спецслужб по изъятию ксив Дмитрий Кочетков, руководитель пресс-службы УФСБ РФ по Петербургу и Ленобласти.

Однако если в удостоверении указано «эксперт» или «внештатный специалист», доказать преднамеренность нарушения сложно. Если же это удается сделать, несчастливому обладателю грозит максимум шесть месяцев ареста, а на практике всего лишь крупный штраф.
Статьи за «фантики» нет. Тем, кто их предъявляет, предлагают сдать «корочки» вместе с поддельным пропуском, который, как правило, выставляется на лобовое стекло. Большинство таких документов нарушают федеральный закон №88-ФЗ, используя герб России. В законе же прописано, кто и где может использовать государственную символику.
Членам «союзов ветеранов» всяческих силовых ведомств вообще ничего не грозит, если они получили свои документы на основании закона об общественных организациях, и во внутренней вклейке удостоверений нет нарушающих закона элементов.
Закон регулирует использование символики спецслужб и государственной символики, однако, наказание за это правонарушение - не серьезное. В США подделать значок полицейского возможно, однако в законодательстве четко прописано, что вместе со значком государство передает человеку и часть своего суверенитета, а подделка признаков власти - это уже не баловство, а покушение на государственный суверенитет. И наказание соответствующее. В России нарушители чаще всего отделываются штрафами.
Среди городов лидируют в производстве поддельных удостоверений и «фантиков» Москва и Северный Кавказ.

В жизни встречаются ситуации, в которых граждане сталкиваются с сотрудниками правоохранительных органов, но не вполне уверены в их ведомственной принадлежности, - поясняет Дмитрий Кочетков. - Обычный человек вряд ли способен без подготовки отличить настоящее служебное удостоверение от высококачественной подделки. Так можно выявить только наиболее одиозные «фантики». К тому же, попытка воспрепятствовать действиям лиц с удостоверениями может закончится тем, что вас привлекут к ответственности, конечно, если «силовики» окажутся настоящими. А если речь идет о преступниках, то, оказывая им неподготовленное сопротивление, вы можете поставить под угрозу свою жизнь и жизни окружающих.
В ФСБ рекомендуют запомнить приметы человека, предъявившего подозрительный документ, одежду, номер автомобиля, черты его лица, и сообщить в полицию. Оперативные ситуации бывают разными. Но спор о признаках подделки и попытки доказать свою правоту могут очень быстро перерасти в сопротивление сотруднику при исполнении. А это уже настоящая статья уголовного кодекса.

Немного подробностей по цветам:
Цвет зависит:
красный - от должности
зеленый или синий - от звания.
Зеленый фон и сейчас есть у пограничной службы, красный у тех, кто имеет звание от полковника и выше.
Удостоверения на желтом фоне - без разрешения на ношение огнестрельного оружия, а именно выдают гражданскому персоналу.
От рядового до старшего прапорщика, включая курсантские удостоверения сероватого цвета (например водители). От лейтенанта до капитана (включительно) синие - должности например, оперативники и сотрудники. Старший офицерский состав (начальники и заместители начальников отдела) - розоватые.
Нумерация:
Номер удостоверения и личный номер шестизначный. Только личный номер еще имеет букву впереди С, Е и даже ЕА.
Примечания:
- у внештатного сотрудника ФСБ удостоверения такие же, но без разрешения на ношение огнестрельного оружия. Удостоверения внештатных сотрудников "пробиваются" через дежурку управы своего округа, поскольку указанные должности присутствуют в официальном штатном расписании конторы.
- у курсантов Академии ФСБ присутствует слово "Академия" (справа вверху "Академия Федеральной службы безопасности"), остальное в том числе надпись про оружие, идентично служебному удостоверению сотрудника.

Удостоверения выдаются только аттестованным сотрудникам, у не аттестованных только пропуска.
Кроме того в большинстве управлений на постоянном ношении удостоверения находятся только у оперативных сотрудников. Остальные сотрудники (кадры и прочие) получают удостоверения при входе в здание и сдают при выходе. На постоянном ношении у всех есть пропуска, утеря или кража которых не так страшна, как например удостоверения.
Каждый гражданин знает, что сотрудник полиции — лицо должностное, он имеет массу прав, недоступных обычному человеку. Однако эти же права накладывают на него массу ответственности. Так, например, должностные лица значительно больше (в 3 — 5 раз) платят за нарушения правил ПДД, к ним можно применить особые меры наказания (например, превышение должностных полномочий), за ними постоянно следят различные контролирующие органы.
Одним из самых первых вопросов при встрече с полицейским является «Должен ли сотрудник полиции предоставить свои документы?». Прежде, чем ответить на этот вопрос, сначала рассмотрим то, какие документы у полицейского должны быть.
Самый важный документ для любого полицейского — его удостоверение. Это небольшая красная книжечка, содержащая в основном номера — идентификаторы. Из информации о владельце там имеется только ФИО и фотография. Удостоверение имеет следующий вид:
- Левая половина — фотография, эмблема государственного органа, личный код, дата действия удостоверения, голографическая наклейка;
- Правая половина — номер удостоверения, должность сотрудника, ФИО сотрудника, печать подразделения, штрих — код, дата выдачи удостоверения, подпись руководителя отдела, в котором удостоверение выдано.
Удостоверение — самый главный документ сотрудника полиции. Без него полицейский — обычный человек, не имеющий прав, положенных ему по долгу службы. Остальные же документы, которые должен предоставить сотрудник полиции, зависят от обстоятельств, по которым сотрудник к вам обратился. Например, для обыска потребуется ордер, а для ареста — постановление суда.
Должен ли полицейский предъявить вам свое удостоверение при обращении?
Да. Это его обязанность. Однако сотрудник полиции обязан показывать свои бумаги только в том случае, если вы их у него попросите — он не должен подходя к вам держать перед собой раскрытое удостоверение.
Так же сотрудник полиции при обращении должен сообщить вам ФИО и занимаемую им должность. После этого он обязан назвать вам причину обращения и, если она веская или предполагает применение к гражданину каких либо мер, предоставить бумаги, эти причины или меры поясняющие и подтверждающие.
В некоторых случаях сотрудник не обязан предварительно показывать свои документы. Возникают такие случаи в особых ситуациях, когда сотрудник полиции не может обратиться к гражданину без риска. Например, при оперативном задержании. Стоит отметить, что все эти меры согласованы судом и полностью законны. Однако обычным гражданам с такими мерами, как правило, сталкиваться не приходится.
Когда еще сотрудник не обязан показывать документы?
Сотрудники полиции не должны предъявлять свое полицейское удостоверение в том случае, если гражданин обращается к ним за помощью. У простых граждан нет возможности проверки документов у должностных лиц просто по желанию. Это указано в законе «О полиции». При обращении к сотруднику полиции он должен будет только представиться и назвать свою должность, а так же оказать помощь в рамках своей компетенции.
Стоит отметить, что у полицейских тоже есть права, и они легко могут быть нарушены простыми гражданами. Зачастую отказ предоставить документы при обращении к сотруднику полиции ошибочно расценивается как нарушение законодательства и влечет за собой жалобы в МВД и подобные инстанции. Такие жалобы не правомерны.
Как должны вести себя сотрудники полиции при общении с гражданами?
Большой вопрос вызывает то, как сотрудники полиции вообще должны себя вести. На самом деле есть отдельное постановление, описывающее вид и характер общения между сотрудниками полиции и простыми гражданами, действующими как в случае обращения полицейского к гражданину, так и при обращении гражданина к полицейскому. Описано оно в части пятой «Закона о полиции» и гласит следующее:
- Сотрудники полиции должен уважать права других граждан;
- Общение должно проводиться без унижения чести и достоинства, диалог должен быть уважительным;
- Сотрудники полиции должны действовать только в рамках своих полномочий;
- Сотрудники полиции должны оказывать всю необходимую посильную помощь;
- Личная информация граждан, переданная сотрудникам полиции в ходе выполнения их обязанностей, не должна разглашаться.
Стоит отметить, что это правило распространяется не только на полицейских, но и на любые правоохранительные органы. От граждан, общающихся с полицейскими, ожидается то же самое.
Что делать, если сотрудник полиции не предъявляет документы?
Если остановивший вас сотрудник полиции либо не показал по требованию удостоверение, либо ведет себя неподобающим образом, то вы имеете полное право подать на него жалобу. В этом случае стоит подать на него жалобу. Для этого узнайте его ФИО и номер отделения, за которым он закреплен. Если в отделении вашу жалобу не приняли, то обратитесь в прокуратуру.
Бывает и так, что сотрудник не только не показывает документы, но и не представляется. В этом случае вы можете вызвать полицию. Разобраться в ситуации должен уже второй полицейский. Весьма вероятно, что первый «сотрудник полиции» — мошенник.

Я вполне сознательно не стану показывать лиц героев этого репортажа и номера их машин. Хотя и имею на это полное право. Но я постараюсь быть максимально этичным по отношению к этим людям. Несмотря на то, что они нарушают закон. Несмотря на то, что делают это, по всей видимости, постоянно. Я поступаю так не из жалости к ним, а по той простой причине, что дело в этом случае вовсе не в конкретных личностях. Дело в том, что данное правонарушение не имеет конкретного лица. Зато имеет устойчивую тенденцию: последнее время таких правонарушителей становится все больше. Впрочем, узнать некоторых персонажей при желании все же можно. Но обо всем по порядку.
Любой журналист знает: сотрудники ФСБ идут на контакт с прессой неохотно. Еще менее охотно идут на это работники службы безопасности этой структуры. Тем удивительнее, что приглашение поучаствовать в этом рейде исходило именно от них. Как выяснилось, в Федеральной службе безопасности решили объявить войну владельцам незаконных удостоверений и пропусков. Такие зачастую показывают сотрудникам ГИБДД нарушившие правила автовладельцы.
Подобными удостоверениями, как правило, не тыкают госавтоинспекторам в лицо. Но, предъявляя права, как бы невзначай показывают и эти документы. В этой машине сидит как раз владелец таковых:
В руках у работника ФСБ "корочки", в которых написано "генерал-полковник". Правда, не указано, какого рода войск. Хотя, может это генерал милиции? Сам владелец этого чина рассказал, что он генерал-полковник казачьих войск. Правда, столь важное уточнее сделал не сразу. Зато вел себя весьма заносчиво, кому-то звонил, кого-то просил подъехать, переговорить с кем-то по телефону предлагал сотрудникам правоохранительных органов.
Это - "добыча" покрупнее. Заместитель одного из начальников отделов Министерства регионального развития:
Я не брал должность этого господина в кавычки, потому что она вполне себе реальная. Правда, у него оказалось еще одно удостоверение - сотрудника некоей комиссии по противодействию коррупции. Документ оформлен, как надо, - российский триколор, печать. Но реальность существования такой комиссии сразу же вызвала сомнения. Не знаю, излишним ли будет упомянуть, что как и любой добропорядочный чиновник, он ездит на Mercedes Gelandewagen, стоимостью от пяти миллионов рублей, и носит с собой травматический пистолет.
Продолжаем общаться с нарушителями ПДД. Аббревиатуры МВД и ФСБ - самые популярные у владельцев таких вот документов:

Тут я сделаю небольшое лирическое отступление. Дело в том, что эти люди вовсе не выдают себя за сотрудников силовых ведомств. Как правило, они якобы являются членами всевозможных якобы ассоциаций, фондов, советов помощи сотрудникам/ветеранам/инвалидам (нужное подчеркнуть) ФСБ/МВД/спецназа/боевых действий (нужное также подчеркнуть). Правда, при этом название госучреждений написано большими буквами, а наименование организации - мелкими где-нибудь внизу. При этом на бумаге, как правило, красуется триколор и гербовая печать. По закону, использование госсимволов, ровно как и наименований государственных учреждений в названиях организаций запрещено. Кстати, правонарушителей в ходе этого рейда не задерживали. Если, конечно, они добровольно расставались с "корочками". В противном случае предлагали проехать в отделение и оформить административное правонарушение. Желающих не оказалось.
Закон, как известно, "что дышло". Вот и Министерство юстиции с чьей-то легкой руки обзавелось собственным "Комитетом защиты прав потребителей".
А если судить по некоторым бумагам, борьба с коррупцией в нашей стране идет не жизнь, а на смерть:
Подлинность документов, кстати, устанавливают тут же. С помощью приглашенного эксперта-криминалиста. Подобные удостоверения, по его словам, не доллары, их изготовители особо не утруждают себя. Полевой набор оптической техники для определения фальшивок уменьшается в небольшую сумку:
Экспертиза проходит одна за другой. Владельцев всевозможных "ксив" так много, что специалисту приходится практически бегать от одной машины к другой. Еще одного обладателя заветной "корочки" просматривают насквозь.
Да, и это тоже общественная организация. Данный "судья" мало того, что долго спорил с сотрудниками ФСБ и ГАИ, так еще и решил, что я, снимая на улице, нарушаю неприкосновенность его частной жизни. Плоховато со знанием законов у выпускника юридического факультета. Надеюсь, выпускника.
В этой машине сидит еще один "генерал". У него сразу несколько удостоверений, подтверждающих свой статус. Очередная общественная организация, разве что в названии которой имеется слово "международная". Как и полагается генералу, управляет он Mersedes S-класса, стоимостью от четырех с половиной миллионов рублей.
Этот солидный чин тоже первым делом начал кому-то названивать:
А вот здесь уже все серьезнее. В удостоверении молодого человека в черной куртке значилось, что его зовут Сергей Владимирович, и он - следователь отдела расследований преступлений экономической направленности Следственного комитета при прокуратуре РФ. И если предыдущие правонарушения карались в соответствии с Административным кодексом, то это - уже уголовное преступление.
Кстати, один из немногих водителей, что не стал спорить с работниками правоохранительных органов и тут же признался, что купил этот документ в подземном переходе за тысячу рублей. На лобовом стекле красовалась такая вот бумага:
Участники рейда шутили, что им еще не попадались разве что ветераны Куликовской битвы.
Сотрудникам ГАИ, кстати, не чужда жалость. На этот раз девушка на Peugeot. Если судить по бумагам, трудится в должности помощника руководителя "Бюро правовой защиты ветеранов ФСБ и МВД". Вспомнить имя своего шефа почему-то не смогла. Несмотря на это, инспектор ГИБДД попросил не показывать фотографию и имя дамы даже на фальшивке. Я не черствый человек, поэтому указал инспектору, куда положить пальцы:
На пропуске указано - "Правительство Москвы". Это на самом деле дама-чиновник из правительства Москвы. Думаю, нет ничего предосудительного в том, что в правительстве Москвы разбираются в автомобилях, цена которых от трех миллионов рублей и выше.
Еще один чиновник. Машина поскромнее, ну да это и не столичное правительство, а так - одна из префектур:
Еще одно небольшое отступление от темы. У владельца этого шикарного Jaguar не было пропуска или удостоверения, наподобие упомянутых выше. Его остановили, что называется, по наитию. Инспекторы не промахнулись. Водитель оказался без водительского удостоверения (!), на руках было какое-то временное, да и то просроченное - цифры оказались исправлены от руки.
Вообще, во время этого рейда я для себя открыл много нового. В частности, узнал наименования немалого количества организаций:

На этот раз обошлось без эксцессов. Хотя во время прошлого подобного рейда пришлось вызывать группу захвата. Водитель Audi Q7 заперся в своей машине и не желал ни с кем общаться и выходить. Подействовал только приехавший спецназ, сотрудник которого предупредил, что на счет "три" разбивает стекло прикладом автомата.
Через пару часов количество "трофеев" насчитывало десятки. Инспекторы не знали, куда их сложить, в бардачок машины эта кипа могла не поместиться.
Самое сладкое оставляю на конец: в этом автомобиле никто иные, как разведчики!
Правда, до сих пор не могу понять, зачем разведчику удостоверение, в котором написано, что он "разведчик"? Может, лучше сразу пойти сдаться с поличным? Кстати, разведка оказалось непростой. В данном господине что-то есть от Бэтмена, не находите?
